Frank Gilbert on the landmark Supreme Court Case Muller v. Oregon
Frank Gilbert is the grandson of former Supreme Court Justice Louis Brandeis. Before joining the court, Louis Brandeis argued cases as an attorney in front of the Court. One of these was the landmark 1908 Muller v. Oregon case in which the famous “Brandeis Brief” was filed in which outside empirical data was first used in a case in front of the Court. This set a precedent for many future cases argued at the Supreme Court. In this case, representing the state of Oregon, attorney Brandeis gathered data from around the country and the rest of the world on reasonable working hours for women.
